Both parties attended the hearing on 8 July 2026.

The tenancy began on 1 February 2018 and ended on 10 January 2022. The landlord filed their application on 6 March 2026. There is a bond of $740.00, which is held with the Bond Centre and assigned to this tenancy. The landlord’s application states that the bond should be refunded to them to cover rent arrears and repair costs to paint a wall inside the premises.

At the hearing, the landlord withdrew their claim, acknowledging that the evidence submitted by the tenant proved no rent was owing at the end of the tenancy and the tenant paid $380.00 to cover the painting costs on 4 January 2022. The landlord claims they forgot about these facts, which occurred 4 years ago and the landlord no longer has access to emails shared between the parties in 2022.

The landlord accepts the tenant’s submission that the tenant overpaid their rent by one week ($530.00) following the end of the tenancy and the landlord has not returned this to the tenant. The tenant has not filed a cross-application for the overpaid rent.

The parties have requested that the Tribunal determine what should happen with the bond of $740.00. Both parties accept that a bond of $1,900.00 was paid by the tenant at the beginning of the tenancy and forwarded to the Bond Centre. The parties also accept that $1,900.00 was refunded by the Bond Centre to the tenant at the end of the tenancy. Neither party was able to explain why, in these circumstances, the Bond Centre still holds a bond of $740.00 for this tenancy. Neither party submitted any evidence as to the origin of the bond and were happy for the Tribunal to make some enquiries to determine the issue.

Following the hearing, I asked the Bond Centre to provide some clarification. In an email sent me on 8 July 2026, the Bond Centre advised the following: ... I can confirm that the tenants for 4A Tully Street, Muhammad and Rahana received a refund of $1900 on 14/01/2022. Their bond record, BN-16023337 has an additional $740 remaining. This money was originally part of a former tenancy and was due to be refunded to the tenants. While waiting for the tenants to confirm their bank account details, we received bond transfer requests for a different tenancy; however, the wrong bond number was provided to us initially, resulting in the $740 being transferred in error. The correct bond was also transferred, resulting in an excess. The breakdown we have for Tully Street is as follows: $740 transfer to Tully Street $860 transfer to Tully Street $1040 lodgement to Tully Street -$1900 refund from Tully Street to Muhammad and Rahana ...

From this email, it is clear that the bond of $740.00 held with the Bond Centre and assigned to this tenancy belongs to the tenant. It was paid by the tenant as security for a different tenancy and transferred to this tenancy, because the incorrect bond number was provided on a bond transfer form. In these circumstances, I order the Bond Centre to refund the bond to the tenant in full.

I do not make an order that the landlord pay the tenant $530.00 for the overpaid rent, because the tenant has not filed an application with Tenancy Services for this.

Because the landlord has not been wholly or substantially successful with their claim, I do not order the tenant to reimburse the filing fee. For the same reason, I decline to grant the landlord’s request for name suppression.
