Tenants are not ordinarily obliged to clean carpets at the end of the tenancy as a matter of course. In this instance, the photos show that at the end of the tenancy, there was a square brown mark where some furniture had been placed. According to a report from Jae’s Carpet Cleaning: The shape of the staining would indicate that some pieces of furniture have been sitting on the carpet in that area. This type of staining on carpet we would usually see when there has been some sort of water damage in the area (maybe from a spill?) that has caused the tannins from the wooden furniture to leach out and stain the carpet.

The tenants have no knowledge of any spill and cannot explain the mark. They had placed a bedside cabinet there in their son’s room and then removed it at the end of the tenancy. They did not notice the mark when they were moving out. They accept that it was not there at the start of the tenancy.

It is understandable that the tenants are reluctant to pay for carpet cleaning when they have no knowledge of how the marks appeared and they had ensured that the property was cleaned at the end of the tenancy. However, I am satisfied that it is more likely than not that the mark in the bedroom occurred during their tenancy and because of small spill at some stage. It is reasonable that the tenants pay the $156 carpet cleaning.

Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.

Because the parties reached consent on most matters, I have ordered non- publication of the parties’ names.
