- [The tenant/s] must pay [The landlord/s] $4,455.00 immediately, calculated as shown in table below.
- The Bond Centre is to pay the bond of $1,290.00 (BN-15867377) to [The landlord/s] immediately.
Reasons
- The landlord attended the hearing. The tenant did not.
- The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
- The tenancy ended on 1 April 2026.
- The landlord provided rent records and utilities invoices which prove the amount owing at the end of the tenancy.
- I order the tenant to pay the landlord $1,820.00 for rent arrears and $810.00 for utilities.
- The tenancy ended abruptly at the tenant’s request, and the tenant could not do any cleaning, rubbish removal, or furniture removal at the end of the tenancy.
- As a result, the landlord had to undertake significant cleaning, rubbish removal and furniture disposal.
- The tenant had texted the landlord with his suggested values of the items that were left remaining. However, having seen the photos, I do not find that there would have been any value that would have exceeded the cost of storage of the items. I do not find any fault with the landlord not having tried to sell the remaining furniture.
- The landlord did not have the means to get a contractor in for the cleaning, repairs and rubbish removal.
- The landlord calculated the labour and material costs incurred. I have carefully considered the original $3,154.34 claimed. Taking into account that the landlord is not a professional cleaner and would have taken longer than professionals, and that she was able to keep the left-over materials, I grant $2,500.00 for this claim.
- The landlord obtained a quote for removing the concrete pad built by the tenant that had been used as a base for a spa. This must be removed. I order the tenant to pay the landlord $587.00 for its removal.
- Because the landlord has wholly succeeded with the claim, the tenant must also reimburse the landlord’s filing fee.
- The bond held at the Bond Centre will be released to the landlord to offset the amount payable by the tenant to the landlord.
