- Vikash Kumar must pay Patras & Co Real Estate Limited As Agent For Bo Zhang And Fan Li $5,255.72 immediately, being rent arrears to 26 March 2026.
Reasons
- Ms Wu, representing the landlord, attended the video conference hearing. The tenant did not join the hearing as per the instructions in the Notice of Hearing so did not attend the hearing. As the tenant was served, the hearing proceeded in his absence.
- The landlord has applied for termination of the tenancy and rent arrears.
- This is a fixed-term tenancy due to end on 9 September 2026.
- The landlord said they received an email from the tenant on 26 February 2026 saying he had vacated the property. The landlord indicated they did not consent to the tenant leaving the tenancy early. They inspected the property on 6 March 2026 and said they found another occupant living at the property, who was not on the tenancy agreement. The landlord reported the tenant denied knowing this occupant, who has since left.
- The landlord said they now have possession of the property. As such, the landlord withdrew the claim for termination of the tenancy.

- The landlord explained they have not reached any agreement with the tenant on an end date for the tenancy, did not consent to the tenant leaving the tenancy early and, given the condition the property was left in and the maintenance and repairs required, they have not yet been able to re-tenant the property.
- As such, the landlord claimed rent arrears to the hearing date, which is 26 March 2026.
- The landlord has provided rent records which prove the amount owing to 25 March 2026, which is $5,162.86. Weekly rent is $650.00 so daily rent is $92.86. A further one day’s rent @ $92.86 is added to bring the total rent owing by the tenant to the landlord to $5,255.72 up to 26 March 2026.
