Reasons

Both parties attended the hearing held on 27 May 2026. The landlord attended by video and the tenant attended by telephone.
The tenant has applied for release of the bond.
The landlord has applied for compensation for odour treatment on the carpet.
The landlord had also applied for water rates and window repairs but those matters have been resolved and the claims are no longer sought. Odour treatment
The landlord has produced an invoice dated 25 March 2026. The invoice records, Carpet Cleaned – odour treatment, applied odour chemical, left for approx. 1 hr, and extracted with carpet cleaning machine. Note: there maybe still some smell after the treatment however we will try our best to eliminate the smell
The landlord says that an inspection was carried out on 27 February 2026 and the inspection report dated 27 February 2026 records that the carpet was smelly.
The tenant does not accept that he should pay the cost for odour treatment. He says that he used a Rug Doctor to clean the carpet and left the premises on 26 February 2026. He said that he returned the keys to the landlord on the morning of 27 February 2026.
The tenant said that the landlord had kept the house closed for a week before carrying out the inspection and it was because of this that the carpet would have smelt as it would have been damp after he had cleaned it. He said that if the carpet smelt it was the landlord’s fault and he should not be responsible.
With both an invoice and an inspection report from the day after the tenant left the premises, both of which confirm the smell, the landlord has provided the necessary evidence to support a claim for odour treatment costs. The claim for odour treatment is ordered.
As both parties have had some success with their applications I make no award for reimbursement of the filing fee.
