- Kāhui Tū Kaha Limited is granted possession of the premises at Unit/Flat 7, 33B Smythe Road, Henderson, Auckland 0612 from 11.59 pm on Thursday 16 April 2026.
Reasons
- The landlord attended the hearing which was held by video conference, and was represented by Mr Ese-Proctor. The tenant did not seek to be admitted to the hearing.
- The tenant has been served notice of the application to his tenancy address which is in accordance with the provisions of the Residential Tenancies Act, 1986. In such circumstances I am prepared to conduct the hearing in his absence.
- The landlord has applied for possession of the premises following the termination of the tenancy.
- The landlord served a 90-day termination notice on the tenant on 11 December 2025. The termination date given was 11 March 2026. This is less than 90 days ago. The requirements of section 64(1) of the Residential Tenancies Act 1986 are satisfied.
- On 13 March 2026 the landlord sought to conduct a routine inspection of the premises but was denied entry. The tenant had not vacated the premises.
- The landlord made an application to Tenancy Services for possession of the premises on 20 March 2026.
