An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord name and identifying details.

The tenant must grant the landlord access to the premises as follows: a. The landlord is granted access to the premises for the purpose of a bio clean and the delivery of a mini skip bin. The landlord is to provide the required statutory notice period in writing to the tenant, but no earlier than Wednesday 10 June 2026. b. The landlord is granted further access to the premises for the purpose of preparing a scope of work schedule. The landlord is to provide the required statutory notice period in writing to the tenant, but no earlier than Wednesday 17 June 2026. c. The landlord is granted further access as required for the purposes of maintenance subject to the required statutory notice period being provided in writing to the tenant.

If the tenant fails to allow access within 5 working days of any access date served on the tenant in writing: a. The tenancy at 19 Greer Crescent, Tawa, Wellington 5028 will terminate and the landlord will have immediate possession of the premises.

Should the tenancy be terminated?

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The landlord served the tenant with a notice to remedy dated 26 March 2026. The tenant has failed to allow the landlord entry for the purposes of an inspection and maintenance.

Where a party has committed an unlawful act intentionally, the Tribunal may award exemplary damages where it is satisfied it would be just to do so, having regard to the party’s intent, the effect of the unlawful act, the interests of the other party, and the public interest. See section 109(3) Residential Tenancies Act 1986.

The landlord is not seeking exemplary damages, and I make no order in this respect.

Access is granted to the landlord accordingly as set out in the Order above.
