The landlord attended the hearing.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord advised that in February the tenant fell behind on rent. They had difficulty getting hold of the tenant. In March someone answered the phone, saying that the tenant had passed away. The landlord was aware that the tenant had cancer and had been in hospital. The landlord asked for an email confirming that, and asked for the key to be returned.
The landlord simply seeks a refund of the bond as partial payment of the outstanding arrears. A rent summary shows that the rent owing up to 25 March was $1360. That amount is ordered.
