Order

Reasons
- Both parties attended the hearing. The landlord attended via videoconference and the tenant attended via teleconference.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated and possession is granted to the landlord, at 11:59 pm on Sunday 12 July 2026. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- The tenant did not dispute owing $17,080.00 for rent and $453.40 for water rates arrears. Accordingly, I order the tenant to pay the amounts to the landlord.
- Because the landlord has wholly succeeded with the claim, the tenant must also reimburse the filing fee.
- The landlord confirmed that he had $2,280.00 as bond from the tenant. The landlord had not lodged this with the Bond Centre. That is an unlawful act. The landlord must treat this as the final warning for him moving forward.
- The bond is to be used to offset the amount owing by the tenant as ordered above.
