Reasons
- This was a continuation hearing after an adjournment to allow for service on the guarantor.
- This service has completed.
- The landlord had applied for termination of the tenancy, rent arrears and refund of the bond. This was ordered on 11 May 2026 as rent was at least 21 days in arrears on the date the application was filed. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord attended the hearing, set down to be conducted via video conference. There was no entry into the conference by the tenant, nor any call in to the conference by one of the telephone numbers provided on the Notice of Hearing. I was satisfied adequate service had completed and I continued with the hearing.
- The guarantor did call in. This was appreciated and her difficult situation is understood. The hearing was an opportunity to explain to her the legal obligations if Rebecca does not resolve the debt immediately.
- The bond was released to the landlord by way of that order.
- The matter was adjourned for service on the guarantor. The guarantor and her obligations were confirmed by a signed, written Guarantee agreement, dated 11 December 2025.
- I now confirm and make the monetary order, as indicated in the previous order, of $2,935.15. Filing fee
- Because Home Rentals 2025 Ltd As Agent For Rocket Fund Trust has wholly succeeded with the claim I must reimburse the filing fee.
