Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord’s name and identifying details.

Reasons
- The landlord attended the hearing. The tenant did not connect via telephone as instructed in the Notice of Hearing sent to them. The hearing proceeded in their absence.
- The landlord has applied for possession of the premises following the termination of the tenancy.
- Section 64 (1) –(2) of the Residential Tenancies Act 1986 apply, which states: 64 Possession orders (1) Subject to subsection (2), on the application of any person entitled to possession of the premises following the termination of a tenancy, the Tribunal shall make an order granting possession of the premises to that person. (2) No possession order may be made more than 90 days after the date of the termination of the tenancy.
- The tenancy ended on 22 April 2026 pursuant to a termination notice dated 21 January 2026.
- The termination notice meets the requirements set out in section 51 of the Residential Tenancies Act 1986. Pursuant to the notice, the tenancy ended less than 90 days ago.
- The requirements of section 64(1) of the Residential Tenancies Act 1986 are therefore satisfied, and the Tribunal is required to make a possession order.
- I have made an immediate possession order which, however, remains subject to the 48 hour “stand down”
- The landlord waived the filing fee.
- The landlord sought suppression and as the application is successful, I have made an order accordingly. See s 95 A RTA.
