Order
- [The tenant/s] owes [The landlord/s] And Karsten Thomsen As Trustees For The Tyson Thomsen Family Trust $6,144.01 (“the debt”) being rent arrears to 4 July 2026 of $6,060.00 and water rates of $84.01.
- [The tenant/s] must pay rent and the debt as follows: a. By paying the current rent of $460.00 beginning on Sunday 5 July 2026 and then weekly on Sundays thereafter. b. By paying the following lump sums on the following due dates: i. $84.01 for wate rates today 2 July 2026; and ii. $3,680.00 by 5 pm Wednesday 8 July 2026; and iii. $1,000.00 by 5 pm Saturday 3 October 2026; and iv. $1,000.00 by 5 pm Sunday 3 January 2027; and v. $380.00 by 5 pm Saturday 3 April 2027.
- Payments will be allocated in the following order: current rent, rent arrears, and the water rates.
- If the tenant fails to pay rent or any of the payments required under Order 2(b)(ii – v) within 2 working days of the due dates: a. The tenancy at Unit/Flat Flat 5, 15 Weaver Street, Whau Valley, Whangarei 0112 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- If the tenant fails to pay the water rates within 2 working days of the due date, the water rates will be payable immediately.
Reasons
- Both parties attended the video hearing.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
