- The tenancy of Judith Helen Hogan and Dwayne Mark Hogan at 11A Werrina Crescent, Mangakakahi, Rotorua 3015 is terminated and possession is granted immediately.
Reasons

- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.
Should the tenancy be terminated?
- The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
- Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
- The tenants have breached their obligations by permitting a dogs and cats to urinate and defecate inside the premises and cause damage to the premises over a sustained period, and not taking steps to remove the animals and reinstate the premises.
- I have viewed photographic evidence and the attending tenant has acknowledged pet damage and related, offensive odour.
- The landlord has served a valid 14-day notice on the tenants and the tenants did not remedy the breach within the required period.
- It would be inequitable to refuse to terminate the tenancy because damage is continuing to occur at the premises and the animals remain.
- The Landlords may bring a further application with respect to compensation once they have retaken possession and quantified their loss and can provide clear evidence; e.g. photos and paid invoices.
