The Landlord's estimate of the amount owing changed when the Landlord worked through their spreadsheet for the year. The Landlord denied being irresponsible and explained that the property had been placed on the rental market because they were required to meet the costs of their ill father's hospital treatment.

The Tenant bears the onus of proving their claim. Ordinarily, claims for rent arrears are brought by Landlords seeking recovery of rent said to be owing. In this case, however, the Tenant seeks a declaration that no rent is owing. To establish that position, the Tenant needed to provide evidence of the rent payments made, preferably in the form of a rent summary or bank statements or a payment table that would allow the Tribunal to determine when and how much rent had been paid. No such evidence was provided. Although the Landlord referred to having a spreadsheet, it was not the Landlord's responsibility to establish the Tenant's payment history. The onus remained on the Tenant to provide evidence of the rent payments they had made.

I am not satisfied that the Tenant has established that no rent was owing from the evidence provided.
