The previous Tribunal order

This matter was first heard on 22 June 2026. The Tenants did not attend the hearing.
The Landlord produced a rent summary and bank account records, which showed rent arrears of $7,200. Because the rent was in arrears by at least 21 days, I made an order terminating the tenancy, effective immediately. 1
I also ordered that: (a)possession of the premises is granted to the Landlord; 2 (b)the Tenants must pay the $28 filing fee to the Landlord; and (c)the Bond Centre was to refund the bond of $3,200 to the Landlord. The rehearing application
The Tenants then filed an application for a rehearing. I heard that application today. Since the last hearing, the Tenants have paid the rent arrears of $7,200. The Landlord confirmed receipt of that payment.
The Tenants explained that they had fallen behind in rent due to financial hardship. They had since sold a significant asset – a motorbike – to enable them to pay the rent arrears. They accept that they should move out of the premises, but they want to delay their departure by two weeks to enable them to organise their move and find alternative accommodation. The new orders – by consent
The Landlord has agreed to accept the Tenants’ offer, but only on the condition that the rent continues to be paid. The Tenants agree with that condition. I therefore make the following orders, by consent: (a)the tenancy is terminated under section 55(1)(a) of the Residential Tenancies Act 1986 as at 5 pm 16 July 2026, or immediately if the Tenants miss any future rent payment by more than one working day; (b)possession of the premises is granted to the Landlord as at 5pm 16 July 2026, or immediately if the Tenants miss any future rent payment by more than one working day; (c) the Tenants must pay the $28 filing fee to the Landlord.
I make no orders relating to the bond. Name suppression
The Landlord has been wholly successful in his claim. He is entitled to recover the filing fee of $28. I also order that the name and identifying details of both parties are suppressed. The Landlord is entitled to suppression because he has been wholly successful in his claim. 1 Residential Tenancies Act 1986, section 55(1)(a). 2 Residential Tenancies Act 1986, section 64(3)- a termination order under section 55 has the effect of a possession order granting possession of the premises to the landlord.
I grant suppression to the Tenants because it is in the public interest for tenants who are behind in their rent to pay those arrears. In this case, the Tenants have clearly gone to some effort to do that – they have sold a significant asset - and I am concerned that publication of their names would disincentivise other Tenants doing the same.
