The landlord sent the tenant a 90-day termination notice on 16 February 2026. Because the tenancy is a periodic tenancy, the landlord is entitled to end it by giving the tenant 90-days written notice.

The termination notice was sent to the tenant by email to the email address recorded as an address for service for them in the tenancy agreement. The contents of the notice comply with section 51(3) RTA. The notice states that the tenancy will end on 17 May 2026, which is at least 90 days after 16 February 2026. For all of these reasons, I find the 90-day termination notice is valid

The landlord agreed to extend the termination date to 9 June 2026 at the request of the tenant. The landlord claims they visited the premises yesterday, 11 June 2026, and the tenant has not vacated. I accept the landlord’s evidence.

The tenancy validly terminated on 9 June 2026 and the landlord is entitled to possession of the premises. The landlord has been wholly successful with their application. For this reason, I must order the tenant to reimburse the filing fee and grant the landlord’s request for name suppression.
