Order

An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord and Tenants name and identifying details.
The Tenant shall pay $800.00 to the Landlord in respect of the bond for the tenancy at [Tenancy address suppressed].

Reasons

The Landlord attended the hearing. The Tenant did not appear.
The Landlord has applied for the Tenant to pay their bond.
The Landlord submitted that, when the Tenant initially moved into the property, she paid $800.00 as her portion of the bond. At that time, there were two other tenants residing at the property. The Landlord stated that when the Tenant vacated the property on 2 December 2025, she was advised to recover her share of the bond directly from the ingoing tenants, as the tenancy itself was not due to end until July 2026.
The Landlord further submitted that, in or about February 2026, the Tenant applied to the Bond Centre and was refunded her $800.00 bond contribution. The Landlord said they did not receive any notification or correspondence from the Bond Centre advising that the bond would be refunded to the Tenant. The Landlord also submitted that the incoming tenants did not reimburse the Tenant for her share of the bond because a dispute had arisen between the Tenants.
The Tenant provided a letter to the Tribunal confirming that she had applied to the Bond Centre and received a refund of $800.00. She explained that she did not seek reimbursement from the incoming tenants because she did not know them and was experiencing personal challenges, as well as difficulties in her relationship with the other tenants.
The applicant bears the burden of establishing the claim to the civil standard of proof, namely, on the balance of probabilities.
Section 22B(1) of the Residential Tenancies Act 1986 provides that, where there is a dispute regarding the payment of a bond, either party may apply to the Tribunal for an order determining to whom the bond, or any part of it, is to be paid.
In considering the evidence, I am satisfied that the Landlord has established, on the balance of probabilities, that the Tenant received a refund of $800.00 from the Bond Centre. In the circumstances, I find that the Tenant is required to repay that amount to the Landlord for the Bond. The Tenant will have to resolve any issues relating to her bond contribution with the other tenants.
As the Landlord has been successful in their claim, name suppression is granted to the Landlord. Name suppression is also granted to the Tenant due to the security issues that could arise from the nature of her employment.
