Both parties attended the hearing on 8 June 2026.

The landlord claims the tenancy ended on 21 May 2026 however, the tenant remains living in the premises. The landlord seeks an order for possession to return the premises back to them.

As the applicant, the landlord must prove their claim to the civil law standard of proof, on the balance of probabilities.

Should a possession order be made in favour of the landlord?

On the application of any person entitled to possession of the premises following the termination of a tenancy, the Tribunal shall make an order granting possession of the premises to that person. 1

A landlord may terminate a periodic tenancy in any case by giving at least 90 days’ notice. 2 Analysis

The landlord sent the tenant a 90-day termination notice on 20 February 2026. Because the tenancy is a periodic tenancy, the landlord is entitled to end it by giving the tenant 90-days written notice.

The termination notice was sent to the tenant by email to the email address recorded as an address for service for them in the tenancy agreement. The contents of the notice comply with section 51(3) RTA and there are 90 days between 20 February 2026 and 21 May 2026.

For all of these reasons, I find the 90-day termination notice is valid. The tenancy ended on 21 May 2026 pursuant to the notice and the landlord is entitled to possession of the premises.

The landlord agreed to allow the tenant two weeks to vacate the premises. For this reason, I have directed that the possession order take effect at 11:59pm on Monday, 22 June 2026. Filing fee & name suppression

The landlord has been wholly successful with their application. For this reason, I must order the tenant to reimburse the filing fee and grant the landlord’s request for name suppression.

I have a discretion to grant the tenant name suppression under section 95A(4) Residential Tenancies Act 1986 (RTA). This section requires me to consider the interests of the parties and public.

Publication of the tenant’s name in this decision might adversely affect their ability to secure a new tenancy, which they need to do urgently. The tenant has three children in their care, the youngest of which is 9 years old. It is in the tenant’s interests that they have every chance at success in finding a new tenancy as soon as possible. 1 Residential Tenancies Act 1986, section 64(1). 2 Residential Tenancies Act 1986, section 51(1).

The tenant pays their rent on time and other than not vacating the premises on the required date, the tenant does not appear to have breached the tenancy agreement or RTA in any other way.

For all of these reasons, I find the public interest in publication to be low and outweighed by the tenant’s interest in suppression. I therefore order suppression of the tenant’s name and identifying details.
