An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord’s name and identifying details until the remaining claims have been determined.

Reasons

A representative of the landlord attended the hearing which took place via telephone conference. An attempt was made to contact the tenant, but it was unsuccessful. The tenant has not communicated with the Tribunal as to why he would not attend the hearing, and the hearing proceeded in the tenant’s absence.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, compensation for damage to the premises, exemplary damages and refund of the bond. The landlord also claims the tenant has used the premises for an unlawful purpose.
Today’s hearing dealt with the landlord’s claim for termination and possession.
The remaining claims shall be dealt with at the next hearing.

Should the tenancy be terminated?

Section 56(1) of the RTA provides that where it has received an application, the Termination for non-payment of rent and other breaches: ... the Tribunal may make an order terminating the tenancy if the Tribunal is satisfied that— (a) the other party has committed a breach of any of the provisions of the tenancy agreement (including provisions relating to the payment of rent) or of this Act; and ... (c) that the breach is of such a nature or of such an extent that it would be inequitable to refuse to make an order terminating the tenancy.
The landlord has applied for termination of the tenancy under section 56(1) of the RTA on the grounds that the tenant has committed a breach of the tenancy agreement and/or the RTA that is incapable of remedy.
The landlord says they inspected the premises on 27 May 2026. The landlord has provided photographs taken at that inspection. These photographs show that it is more likely than not that the premises have been used for or intended to be used for unlawful purposes. The photographs also show that there is significant damage to the premises with holes made in the walls and ceiling to facilitate ventilation / extraction systems, plastic lining has been laid throughout the premises and the windows have been blocked off.

I am satisfied that the damage to the premises is substantial, and that it has been caused during the tenancy. I am also satisfied the tenant has caused or permitted another person to cause the damage.
I am satisfied that the landlord could have made an application to terminate the tenancy under section 55(1)(b) of the RTA.
The tenancy is terminated immediately in accordance with section 55(1)(b) of the RTA.
Immediate possession of the premises is granted to the landlord. Suppression:

The landlord is seeking: a. Orders under section 662B of the RTA for the disposal of abandoned goods; b. Compensation for damage to the premises; c. Exemplary damages; d. Payment from the bond; e. Suppression of the landlord’s name and identifying details. Disposal of abandoned goods:
