Order
- The Tenant shall pay the Landlord $3050.00 for the bond, in weekly instalments of $400.00 each Friday until the debt is fully paid commencing Friday 11 September 2026.
Reasons
- The Landlord attended the hearing. The Tenants did not appear.
- The Landlord applied for an order requiring the Tenants to pay the outstanding bond. The Landlord submitted that the Tenants have paid $350.00 towards the bond but have not made any further payment. The Tenants also failed to attend mediation, and the Landlord has experienced difficulty engaging with the Tenants to obtain payment of the outstanding bond.
- Section 18 of the Residential Tenancies Act provides that a Landlord may lawfully require a general bond of no more than four weeks’ rent.
- The Landlord has requested a bond equivalent to four weeks’ rent. The Tenants have failed to pay the bond in full and are therefore required to pay the outstanding balance.
