Order
- [The tenant/s] owes Rent Wise Property Management Limited $3,498.00 (“the debt”) calculated as shown in the table below.
- [The tenant/s] must pay rent and the debt as follows: a. By 34 weekly payments of $610.00, being $510.00 for rent and $100.00 for the debt. b. A final payment of $608.00, being $510.00 for rent and $98.00 for the debt. c. Payments will be every Wednesday, with the first payment on Wednesday 22 July 2026 and continuing until 17 March 2027.
- Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 123 Beresford Street, New Brighton, Christchurch 8061 will terminate, and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.
Reasons
- Both parties attended the hearing by video conference.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligation to pay rent, rent arrears and payment of the bond.
- Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must make a termination order. See sections 55 and 56(2) of the Residential Tenancies Act 1986.
- Rent is at least 21 days in arrears at the hearing date. There must therefore be a termination order.
- The parties have agreed that there should be a conditional termination order that requires the tenant to pay the rent as it falls due plus $100 towards the rent arrears. I have therefore made a conditional termination order in the terms agreed by the parties.
- The landlord provided rent records to prove the amount owing to the end of the current rent week and the tenant does not dispute it.
- The landlord has succeeded and so I have awarded the filing fee.
