- An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord’s name and identifying details.
- The tenancy of [The tenant/s] tenant/s] at 10 Holborn Place, Papatoetoe, Auckland 2025 is terminated, and possession is granted to [The tenant/s] landlord/s], at
- 59pm today, Thursday 13 August 2026.
- [The tenant/s] tenant/s] must pay [The tenant/s] landlord/s] $6,773.00 immediately, calculated as shown in the table below:
Reasons
- The hearing was held by video conference. The landlord attended, represented by [Property Manager]. The tenant did not join the hearing and so I placed a call to the tenant at the mobile number provided. That call went to voicemail.
- I am satisfied that the tenant has been served with the landlord’s application in accordance with the relevant provisions of the Residential Tenancies Act 1986 and so the hearing proceeded in the tenant’s absence.
- This tenancy began on 23 May 2025 and is ongoing.
- The landlord has applied for termination of the tenancy and rent arrears.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing, in the amount of $9,925. The rent ledger records the last rent payment having been made by the tenant on 26 June 2026.
- The landlord advised that a bond of $3,180.00 was paid by the tenant but does not appear to have been lodged. I have therefore applied that bond to offset the amount owing by the tenant.
- Because [The tenant/s] applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
- The landlord also sought an order for name suppression and is entitled to an order as the successful party (see section 95A RTA).
