Reasons

Only the landlord’s representative attended the hearing which was conducted by video conference. The respondent did not join the hearing, and a call made to her mobile telephone number at the time of the hearing went straight to voicemail.

The landlord has applied for a possession order on the basis that the respondent is a trespasser or squatter.

On the application of a person entitled to possession of residential premises where the Tribunal is satisfied that the other person is a squatter or trespasser or is otherwise not entitled to possession, the Tribunal must make a possession order granting possession of the premises to the applicant (s65 Residential Tenancies Act 1986 (the Act)).

The applicant bought the premises from the mortgagee earlier this year and settlement occurred on 11 June 2026.

The previous owner of the premises was not contactable, and little was known about who, if anyone, occupied the premises. The last record of a tenant living at the premises was in 2022 and that is confirmed by a Tribunal order terminating the tenancy in September 2022.

The applicant has contacted the respondent who claimed to be the tenant of the premises although there appears to be little evidence that she has been occupying them. The applicant has a mobile telephone number and email address for the respondent which were used for service of the application and her full name is known from a letter delivered to the premises.

The respondent has been given ample opportunity to provide evidence that she is a tenant of the premises, but she has not produced any.

Matters came to a head on 27 July when the landlord’s representatives met the respondent at the premises for an arranged inspection. The respondent and her partner became threatening, and the representatives called the Police who attended and removed the respondent and her partner from the premises. The representatives then changed the locks of the premises. They have subsequently delivered some personal belongings from the premises to the respondent.

Although the applicant has possession of the premises, they are unoccupied and there is a concern that the respondent may attempt to re-enter them. I am satisfied that the respondent has occupied the premises as a trespasser or squatter. The conditions under s65 of the Act have therefore been met and it is appropriate to make a possession order in case it is needed in the future. I have therefore done so.
