Decided 28 Aug 2026 · Published 28 Aug 2026 · Application 5539838
- Rent arrears
Order
- [The tenant/s] tenant/s] will owe Otautahi Community Housing Trust $1,176.04 (“the debt”) calculated as shown in the table below.
- [The tenant/s] tenant/s] must pay rent, and the debt as follows: a. $150.80 rent on 30 August 2026. b. From 6 September 2026 and every Sunday thereafter $174.67, being $164.67 for rent and $10.00 for the debt payments, until the debt has been paid in full.
- If the weekly rent changes this order will apply requiring the tenant to pay the weekly rent plus $10 for the debt.
- Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at Flat 11, 182 Ensors Road, Waltham, Christchurch 8023, William Massey Courts will terminate, and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.
Reasons
- Only the landlord’s representative attended the hearing.
- The landlord has applied for termination of the tenancy, rent arrears and payment of the bond.
- Where rent is at least 21 days in arrears on the date the application was filed, as it is in this case, the Tribunal must make either a final or a conditional termination order.
- The landlord is content with a conditional termination order and so I have granted an order in the terms sought.
- The tenant has been allowed a one-week grace period before the additional pay towards the debt must be paid to enable him to obtain any assistance he need from WINZ.
- This conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach.
