A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 25 June 2026, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord had arranged for a routine inspection of the property with the tenant. When the landlord arrived for the routine inspection on 25 June 2026, the landlord said the tenant was not present and all the furniture and personal belongings of the tenant had gone. The landlord provided a number of photographs of the inside of the property taken on 25 June 2026, which show all the rooms inside the property empty of furniture and personal belongings, along with dirt and damage. The landlord provided copies of texts with the tenant and said the tenant had not responded to their attempts to contact them. I am persuaded by this evidence that the tenancy has been abandoned.

The landlord provided rent records which show there were rent arrears at the date of filing the application.

The tenant has not contested the claim.

All the requirements for an expedited abandonment application have been met. Because the premises have been abandoned, and rent is in arrears, I am terminating the tenancy immediately.
