The information provided by the landlord with the application is sufficient to enable the Tribunal to determine it properly without a hearing (either on the basis of that information alone or with only minor clarifications).

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 28 July 2026, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord said the police executed a search warrant at the property on 28 July 2026 and discovered a commercial cannabis growing operation at the property. The landlord provided a copy of the search warrant and a number of photographs showing the condition of the inside of the property. The photographs showed rooms empty of furniture but with drop sheets on the floors and walls, plastic coverings on the walls, fans, multiple power cords dropping down from the ceilings with large bowls on the floor under these power cords, shelving with multiple types of power cords, large ventilation ducts and much other growing equipment. The landlord said the police turned off the power due to safety issues and said there has been significant damage to the property. The landlord indicated they were initially not allowed to attempt to contact the tenant due to the police investigation but when allowed to do so, tried to contact the tenant multiple times without any response from the tenant. I am persuaded by this evidence that the tenancy has been abandoned.

The landlord provided rent records which show there were rent arrears at the date of filing the application.

The tenant has not contested the claim.

All the requirements for an expedited abandonment application have been met. Because the premises have been abandoned, and rent is in arrears, I am terminating the tenancy immediately.
