Order
- The application is dismissed.
Reasons
- The landlord attended the hearing.
- The tenant did not connect to the MS Teams link provided to them and nor did they connect via telephone as instructed in the Notice of Hearing sent to them. The tenant was telephoned on the phone number provided but the phone call was not answered. The hearing proceeded in their absence.
- Prior to this hearing the landlord had applied for an adjournment which was declined.
- The landlord had applied for an order in respect of the tenant parking on the driveway.
- The landlord says this is a breach of the tenancy agreement.
- The application form said the landlord wants the tenant to keep the driveway clear.
- After discussion at the hearing about the evidence in support of the claim and that the tenancy is ending shortly in any event, the landlord withdrew the claim.
- I have therefore not considered whether the relevant clause is reasonable or whether it has been breached.
- The claim is dismissed.
- If the landlord has claims following obtaining possession of the premises, these may be filed as a new application.
- On my enquiry, the landlord did not seek name suppression.
