The Applicant is claiming unpaid levies, interest and collection costs pursuant to s121 and 124 of the Unit Titles Act 2010. The Respondent disputes that the claimed amounts are owed.
The Tribunal can only hear claims up to the jurisdictional limit of $100,000.00. 1
On the 19 November 2024 the Applicant sought to have the claim transferred to the District Court on the basis that the amount sought was now in excess of $100,000.00
The Respondent disputed the transfer to the District Court, but at today’s hearing agreed that the matter should be transferred to the District Court.
I am transferring the claim to the District Court because: a. The Applicant’s claimed amount exceeds $100,000.00. b. The Respondent’s counterclaim raises issues of complexity. 1 Section 171 Unit Titles Act 20210. c. The parties agree to the matter being transferred.
