The Tribunal issued an order on 24 September 2025, in relation to an application filed by the Unit Owner against the Body Corporate, the Unit Owner was not successful in his application.

The Unit Owner applied for an adjournment as he was overseas. That request was declined. I note the hearing was on the papers, the Unit Owner could file submissions from anywhere in the world, or get a representative to file them.

No submissions were filed by the Unit Owner, but fulsom submissions were filed by the Body Corporate Manager on behalf of the Respondents. Rehearing dismissed for non-prosecution.

The Unit Owner has not filed submission on the rehearing application as directed, so the application for rehearing has not been prosecuted. This would be a ground for dismissing the rehearing request. No grounds to approve rehearing

However, even if the rehearing was considered on the basis of the reasons set out in the rehearing application, the rehearing would have also been declined, for these reasons a. Procedural and fairness-I am entirely satisfied that the unit owner had ample time at the hearing to present his case. If the unit considered that the Tribunal had incorrectly applied to any weight to the submissions of Mr Craig, that would be a matter for appeal to the District Court, not rehearing. b. Incorrect assessment of evidence or application of evidence – as noted in the directions regarding the re-hearing, the law is clear that if the argument is that the Tribunal was wrong in its finding of fact or law, that is a matter not for rehearing, but appeal to the District Court.

While the reasons for wanting a rehearing in the rehearing application are extensive, they focus very heavily on the unit owner’s view, that the Tribunal has misunderstood the background and evidence and got the decision wrong. Again, I cannot approve a rehearing on that basis.

The application for rehearing is dismissed.
