Reasons

The Tribunal has received an application filed in its unit titles jurisdiction by two unit owners, against an employee of the Body Corporate Manager (Crockers), and Mr Clareburt the Body Corporate Chair.
I convened a prehearing case conference today to discuss administrative matters. In attendance was Ms Rimkeit and Ms Te Whaiti, who are the applicants, and Ms Koia the respondent. There was no appearance by Mr Clareburt.
The applicants advised their issues relate to governance at the complex.
This morning the applicants have confirmed that they withdraw the application against Ms Koia, and the application should be amended to record the Body Corporate as the respondent.
The applicants still consider that Mr Clareburt should continue to be a respondent, but I note for completeness, I had indicated that there is no ability in the Unit Titles Act 2010 for an application to be filed in the Tribunal against a Chair, any issues they had with what the Chair did in that role would need to be filed against the Body Corporate.
In any event, Ms Koia confirmed that Mr Clareburt has sold his unit and resigned as the Chair. It was clear that this has resolved some of the issues the applicants have, which was the basis for this application.
Following discussion between themselves, the applicants confirmed that this application in whole can now be withdrawn. The withdrawal is accepted, so this matter will now be closed.
