Both parties attended the hearing. The tenants were represented by Nigel Vaenuku, who answered Maryanne Vaenuku’s telephone and said he was representing all of the tenants at the hearing.

I made an order on 4 July 2023 that the tenants pay rent and an extra $100 each week to pay off rent arrears, water rates arrears and the filing fee. The landlord provided me with a rent summary today. The amount of rent arrears is less than at the first hearing because of a lump sum payment by MSD. I am not persuaded this tenancy should end and the application for termination is dismissed.

The payment agreement recorded in my last order continues until the debt is paid in full.

There was a lot of talk about whether or not the landlord would accept rent being paid fortnightly, because two of the four tenants are paid fortnightly. Mr Vaenuku said it is hard for the tenants to arrange weekly payments, and this is part of the reason they fell behind. Mr Vaenuku had a plan to get fortnightly payments started from 1 September 2023, and also to pay rent this week and next week. This was not acceptable to the landlord, who said this would mean the owner missing out on rent because of the way rent is forwarded to the owners.

I note the tenancy agreement is for weekly rent, to be paid in advance. I cannot change the rent payments at this stage without the landlord’s consent. This means the tenants are going to have to arrange weekly payments of rent and the extra $100. If they do not sort these weekly payments it is likely the landlord will file another application.

The landlord is claiming $425 for a plumbing call out, for drains to be cleared, and for a new shower drain cover in the main bathroom. It is agreed evidence there was no cover when the tenants moved in, so this part of the claim is dismissed. I find the landlord should pay two thirds of the remaining bill, because it seems most likely to me the drain without a cover would have needed maintenance anyway. The tenants’ share of the bill for clearing the drain in the ensuite shower is $111, which should be paid immediately.
