Olohau Fangupo must pay rent and the debt as follows: a. By 97 weekly payments of $700.00, being $650.00 for rent and $50.00 for the debt. b. A final payment of $650.00, being $650.00 for rent and $0.00 for the debt. c. Payments will be every Friday, with the first payment on 04/08/2023 and continuing until 13/06/2025.

Payments will be allocated in the following order: rent, rent arrears, and the filing fee.

If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

The landlord attended this remote teleconference hearing.

Telephone calls were made to the tenant on the number provided at the allocated hearing time. All calls went to voicemail. The Tribunal may hear matters in the absence of a party where satisfied that notice of the hearing has been given. Notice of the hearing was given to the tenant by Tenancy Services. I am satisfied that the tenant has received notice of the hearing.

This matter was part heard by me on 17 July 2023. It became apparent during that hearing, that then named tenant in the application, Fatanitavake Kami (who attended the hearing) was no longer the tenant. The tenancy was varied at the end of January 2023 to the intent that the tenant is now Olohau Fangupo. Olohau Fangupo has been served with a notice of today’s hearing.

The landlord has applied for termination of the tenancy and rent arrears. The landlord said in evidence that tenant wants to repay the debt to avoid immediate termination and that the tenant has already been paying $650.00 per week for rent and $50.00 per week towards the arrears.

The landlord’s rent summary includes rent arrears owed by the previous tenant. I have deducted that sum ($2,340.00) from the amount outstanding at the date of the hearing. That leaves a balance of rent arrears as of 1 August 2023 of $4,850.00.If the landlord wishes to pursue the previous tenant for the unpaid rent due at the end of January 2023, a further application will need to be filed with the Tribunal.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

The landlord has applied for name suppression. The landlord has been substantially successful in this matter and suppression of the landlord details is ordered.
