Jacinta Rawiri and Carlo Fono must pay Paragon Property Management Limited - As Agent For Ashfield Estate Ltd $415.44 immediately, calculated as shown in table below.

Reasons

Both parties attended the hearing. Ms Carter the agent and Mr Brent the owner and Ms Rawiri the tenant.
The landlord has applied for compensation for carpet damaged by the tenant’s dog, carpet cleaning and reimbursement of the filing fee following the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

There is no dispute from the tenant that their dog damaged a small part of the carpet in the lounge where the tiles met the carpet. This had to be replaced. The amount of $345.00 is awarded by agreement.
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant vacuumed the carpets.
The agent says there was a dog smell and stains that needed removing from the carpet, particularly from a small bedroom. The tenant says she believes she looked after the property and left it in a reasonable state.
The carpet was already 3 years old when the tenants took over the property.
The pre-tenancy photos provided are not clear and do not show close up of the carpet in the property. The post-tenancy photos show some close up stains but nothing out of the ordinary where a family and a dog are living.
It is not unusual for landlords to professionally deep clean carpets inbetween tenants. This is part of a business. There may have been a dog smell in the carpet that needed some odorising. On that basis I make an award of $50.00 towards the carpet cleaning.
The tenant believes she has a claim to make against the landlord for the state of the property. It has been sometime since this tenancy ended and the tenant will need to make any claims forthwith.
Because Paragon Property Management Limited - As Agent For Ashfield Estate Ltd has substantially succeeded with the claim I have reimbursed the filing fee.
