The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing to 14 August 2023, which is $6,188.00. Weekly rent has been assessed at $396.00, which has not yet been changed by the Ministry of Social Development. One week’s rent at $396.00 is payable from 15 August 2023 to 21 August 2023, which is the end of the tenancy. Therefore, the tenant owes the landlord a total of $6,584.00 in rent to 21 August 2023.

Both parties requested suppression. The landlord is entitled to name suppression as of right. Therefore, I order that the landlord’s name and identifying details are not to be published. See section 95A(1) Residential Tenancies Act 1986 (“RTA”).

Section 95A(4) RTA provides that the Tribunal may, on the application of any party to proceedings or on its own initiative, having regard to the interest of the parties and to the public interest, order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published.

From the evidence, the tenant appeared to have made some efforts to sort out the non-payment of rent by the Ministry of Social Development (“MSD”), even though these efforts did not result in MSD agreeing to pay his rent arrears prior to the hearing. He has applied to have the income-related rent assessment of $396.00 per week re-assessed but that has not yet occurred. In these circumstances and based on the evidence, I find that the interests of the tenant here outweigh the public interest in publishing the tenant’s name. Therefore, I order that the tenant’s name and identifying details are not to be published.
