Both parties attended the hearing.
A hearing was held in September 2023 and an order dated 25 September 2023 confirms that the Tribunal has jurisdiction to hear this claim.
On 24 January 2024 the Tribunal made an order relating to another tenancy in 2022 but between the same parties and concerning the same premises. The previous order is incorporated into this order for enforcement purposes.
This tenancy began on 9 March 2023 and ended on 7 June 2023.
The weekly rent was $450.00, and the bond was $1,800.00.
The bond was paid to the landlord by WINZ on behalf of the tenant. The tenant paid the weekly rent directly to the landlord.
At the end of the tenancy the tenant received $1,000.00 of the bond money and the landlord retained $800.00. At the time the tenant signed a form but questioned why $800.00 was being retained. The receptionist he asked was not sure but thought it related to cleaning.
At the hearing the landlord said that $50.00 was retained for the room key, $50.00 for a food container and $500.00 for cleaning. This does not amount to $800.00, and no evidence was produced to support these claims.
The tenant has applied for refund of the bond. The landlord has not filed a counterclaim with Tenancy Services.
Section 22B(2) Residential Tenancies Act 1986 provides that, where a tenant applies for refund of the bond, and the landlord seeks payment from the bond, the landlord must file an application setting out the details of the counterclaim. Because the landlord has not filed a counterclaim the balance of the bond is refunded in full to the tenant.
In the earlier order exemplary damages were awarded against the landlord for failure to lodge the bond. While the bond money was also not lodged for this tenancy, I do not consider it appropriate to award two amounts for the same unlawful act against the landlord.
Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee. For the same reason I suppress the tenant’s name.
