Reasons

Both parties attended the hearing.
The tenant seek reimbursement of costs incurred during the tenancy. The tenant say that the landlord’s former agent Jaspreet Kaur has agreed with them that the landlord would pay for painting costs, blinds replacement and other incidentals incurred by the tenant totalling $1,295.52.
By email dated 25 September 2023 to the landlord’s current agent Nazia Alia, Ms Kaur accepted the latest receipts from the tenant for $216.57 as “agreed” between the tenant and the landlord for reimbursement of incidentals such as light bulbs and other items.
However, Ms Kaur has clearly indicated to the tenant in her other communications, in particular her text message of 30 May 2023, that the owner only agreed for the tenant putting up the blinds at their own costs on the understanding that the tenant are at liberty to remove them and putting back the old blinds back at the property at the end of the tenancy.
The tenant’s claim for reimbursement of blinds replacement costs therefore fails.
As for the painting costs, I find that the tenant and the owner have agreed for the tenants to reimbursed with the cost of the materials for painting.
While Ms Ali is presently instructed by the owner to say that the owner has never agreed to reimburse the tenant and only ever agreed that the tenant may paint the walls, the text exchanges between the tenant and Ms Kaur on 30 May 2023 shows that the landlord had agreed to reimburse the tenant with painting costs.
At 13.41 hours, the tenant texted to ask for reimbursement of their costs as it has been over 3 months since their email of 8 May 2023.
Ms Kaur responded initially at 13.42 hours with the owner “saying that he do not recall him saying that he will pay for any work you did.”
At 13.43 hours, Ms Kaur then texted to say that work done by the tenant was their will and “he said he agreed for painting not blinds”.
Given the context of the parties’ communication at the material time, I am satisfied that Ms Kaur was representing to the tenant that the landlord had agreed to reimburse the painting costs when she texted “he said he agreed for painting not blinds”.
Accordingly, I order the landlord to now reimburse the tenant on costs incurred by the tenant which has been agreed between the landlord’s former agent and the tenant as set out above.
Only the amounts ordered are proved.
