Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 15 September 2023 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord inspected the premises on this date after finding out from Integrity Services that the tenant had left New Zealand on 1 July 2023.
As part of the terms of the tenancy a tenant is to inform the landlord if they are not living at the premises for more than 30 days. A notice was sent to the tenant reminding them that they were to live at the premises and a date set for a visit on 4 September 2023 to ensure that the tenant was there.
Photographs from the inspection show most of the tenants’ belongings and household items were at the premise. The landlord’s inspection notes state that the power was off ,no one was there, and food was rotting in the fridge.
The tenant was not at the address and the last contact with the tenant was on 8 August 2023.I find that the premises have been abandoned.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
