The landlord attended the hearing by teleconference. The tenants were unable to be contacted on the phone number provided and the hearing continued in their absence.
The landlord has applied for termination of the tenancy for abandonment and rent arrears.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 6 September 2023 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord had noted that the tenancy was in arrears and that they had no contact with the tenants since 28 February 2023.
The landlord inspected the premises on 6 September 2023 and found no one there. Belongings were in bags, food on the bench, a mattress removed from a bed and household items removed. Photographs were provided.
The landlord received confirmation from Integrity services that Joana Maumasi, had left the country.
The landlord does not know of the location of the second tenant, Mr Pula.
A mediation conference as not attended by either party.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
