Order
- [The tenant/s] owes Kāinga Ora-Homes and Communities $434.00 (“the debt”), being rent arrears to 15 January 2024.
- [The tenant/s] must pay rent and the debt by weekly payments of $94.00 being $84.00 for current rent plus an extra $10.00 for the rent arrears. These payments shall begin today, Tuesday 16 January 2024 and continue weekly on Tuesdays until all rent arrears have been paid in full. All money paid will go first to current rent and then to rent arrears.
- If any payment of current rent or rent arrears as specified in order 1) above is not made within two working days of the due date as indicated in order 2) above, the remaining debt will be due and payable in full immediately and is enforceable by the Collections Unit at a District Court or by a Debt Collection Agency. Any court enforcement fee will be added to the balance owing.
Reasons
- The landlord attended the hearing, conducted via teleconference. Two calls to the tenant went unanswered and to voicemail. After the first call, a brief message was left introducing myself and explaining the purpose of the call. The message concluded with the advice I would try a second time after waiting some minutes. I was satisfied adequate service had completed and I continued with the hearing after the second call went unanswered.
- The landlord sought an order for rent arrears. Since the application was lodged the tenant has been paying an extra $10.00 per week to reduce the rent arrears. The landlord is happy for that arrangement to be formalised in this order.
- An updated rent summary was provided today and that confirms the rent arrears as ordered.
