Kāinga Ora–Homes And Communities (the landlord) must continue to store the tenant’s goods, which they removed from the premises following termination of the tenancy, until 4pm on Monday 19 February 2024 on the following conditions: a. The tenant must collect all her goods no later than by 4pm on Monday 19 February 2024 (‘the due date”); b. Provided the tenant collects all her goods by the due date, the landlord will not charge the tenant any storage fee; c. Should the tenant fail to collect all her goods (except for personal documents) by the due date, the landlord may dispose of the goods as the landlord sees fit and may charge the tenant with the costs of disposal; d. Should the tenant fail to collect any personal documents that may be held by the landlord in storage by the due date, the landlord must take any personal documents belonging to the tenant to the nearest Police station and obtain a receipt for them from a Police employee; e. The landlord will contact the tenant through her mother, Mrs Manawai Martin, to make arrangements for the tenant and/or her mother to attend the storage facility at a date and time to be agreed before the due date, to enable the tenant or her mother to collect the tenant’s goods.

Reasons

Both parties attended the hearing by teleconference. The Tribunal granted Ms [The tenant/s]’s request that her mother, Mrs Manawai Martin, assist her as a representative.

The landlord has applied for the disposal of goods the tenant left at the premises after the tenancy was terminated by the Tribunal on 5 October 2022 (see application 4403440).

The landlord has held the tenant’s goods for over 12 months and has been unable to agree with the tenant on a period for the tenant to collect the goods.

I am satisfied that it is not reasonable to require the landlord to store the goods indefinitely and the tenant is responsible to collect the goods. I have made orders giving the tenant further time to collect the goods, failing which the landlord may dispose of them.

The tenant claims that some of her goods may be missing. She will have an opportunity to determine whether that is the case once she has assessed the goods that the landlord is holding in storage. In that case, it is open to her to bring a separate claim to the Tribunal. However, that is not a matter which can be determined by the Tribunal today.
