Fiona Waitangi Rore must pay rent and the debt as follows: a. By a payment of $1,400.00, being $400.00 for current rent and $1,000.00 for the debt on or before Wednesday, 14 February 2024. b. A final payment of $1,259.72, being $400.00 for rent and $859.72 for the debt on or before Wednesday, 21 February 2024.

Both parties attended the hearing which was held by telephone.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears at the date of hearing, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) and s56 Residential Tenancies Act 1986.

The landlord provided rent records which establish the outstanding rent.

Both the landlord and tenant gave evidence that rent had not been an issue until the tenant changed employment. The tenant said that wages were often late or not paid. She has now left the employer and is taking steps to recover outstanding wages. She has started a new job and is confident that the rent arrears can be paid in full next week.

The landlord opposed a conditional termination order being made and gave evidence of payment issues and a lack of communication from the tenant.

I find that the tenant is committed to bringing rent back up to date and to paying the arrears. I am giving the tenant two weeks to pay the arrears, as set out in Order 3 above. That is a realistic and reasonable timeframe. The tenant can pay more than the specified payments if she is able to.

I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
