Ngapera Te Aroha Egan owes GG Blue Enterprises Limited As Agent For Jenny Cho Marie $2,194.29 (“the debt”) being rent owed to Sunday 28 January 2024 which is the end of the current rent week.

Ngapera Te Aroha Egan must pay rent and the debt as follows: a. By one payment of $2194.29 on or before Monday 12 February 2024 for the debt in addition to the weekly rent due.

Payments will be allocated in the following order: rent then rent arrears.

If the tenant fails to pay rent and rent arrears within 2 working days of the due date: a. The tenancy at 16 O'Connell Street, Manurewa, Auckland 2102 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Reasons

The landlord attended the hearing which took place by teleconference. The tenant was called on the number provided three times but the calls went to answerphone. The file records that the tenant was sent notice of today’s hearing. The property manager advised that she called the tenant’s mother this morning to ask her to remind the tenant of the hearing. The hearing proceeded in the tenant’s absence.

The landlord has applied for termination of the tenancy and rent arrears, however, the landlord advised today that they wish to give the tenant the opportunity to repay the debt to avoid immediate termination.

The property manager advised that she has provided the tenant with three letters over the past four months to take to WINZ to seek payment of the debt but to date the debt has not been paid. She wishes to give the tenant one last opportunity to resolve matters.

The landlord agreed to give the tenant until Monday 12 February 2024 to arrange a lump sum payment for the arrears. If this is not paid then termination of the tenancy is sought.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

The landlord advised that the tenant has set up a payment arrangement and the weekly rent is now being paid regularly by WINZ. I am satisfied that if WINZ advances the lump sum for the rent arrears debt the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
