Reasons

Only the tenant attended the hearing, assisted by an interpreter, Ms Tam. I delayed the start of the hearing in case the landlord has been delayed. I am satisfied that the landlord has been served with the tenant’s application and so the hearing then proceeded in the landlord’s absence.
The tenant has applied for refund of the bond. The landlord appears to have a claim against the bond, but has not filed a counterclaim with Tenancy Services.
Section 22B(2) Residential Tenancies Act 1986 (“RTA”) provides that, where a tenant applies for refund of the bond, and the landlord seeks payment from the bond, the landlord must file an application setting out the details of the counterclaim. Because the landlord has not filed a counterclaim the bond is refunded in full to the tenant.
This was a very short term tenancy of only four weeks commencing on 12 November 2023 and ending on 10 December 2023. The relationship between the parties appears to have broken down, seemingly due to religious differences, and the tenant has already involved the police. The tenant has sought compensation and voiced concerns at the hearing about future harassment.
At the hearing I advised the tenant that the Tribunal does not have jurisdiction to deal with this aspect of her claim and that if she has concerns for her safety she should contact the police. In addition, she may wish to seek legal advice as to her options (possibly from a Community Law Centre).
Because [The applicant/s] has substantially succeeded with the claim I have reimbursed the filing fee. As the substantially successful party she is also entitled to an order for name suppression pursuant to section 95A RTA. I do not consider that there is an overriding public interest in publication and so have made an order for name suppression of the tenant’s name.
