The landlord may dispose of the other goods left at the premises by the tenant as the landlord sees fit.

On 06 December 2023, the Tribunal terminated the tenancy, awarded the landlord rent arrears, and ordered reimbursement of the filing fee. On 19 December 2023, the landlord filed an application seeking an order the disposal of goods left at the property by the tenant. On 26 March 2024, both parties appeared at a telephone hearing. The tenant stated that they had not been <No_Application>2 contacted by the landlord and sought an opportunity to visit the property and retrieve items. The parties agreed to meet at the property on 02 April 2024. The tenant undertook to remove the items before 17 April 2024.
This was recorded in the adjournment order. It was also made clear to the tenant that if they failed to remove the items, the Tribunal, having considered the evidence produced, consisting of photographs and an itemised list, would make an order, and award reasonable costs associated.
Ms Serena has appeared by telephone. A call made to the tenant has gone straight to answer phone. Ms Serena states that the tenant failed to keep the appointment on 02 April 2024. Ms Serena states that a call was made to the tenant on 11 April 2024, but the tenant advised she did not wish to discuss the matter further.
As of today, 17 April 2024, the items remain at the property.
I am satisfied that the landlord agreed on a period for the tenant was to collect the goods, but the tenant failed to collect the goods within that time.
It is not practicable for the landlord to the return the goods to the tenant. The value of the goods is below the cost of storing, transporting, and selling them.
The landlord must take any of the tenant’s personal documents left at the premises to the nearest Police station and obtain a receipt for them.
The landlord may then dispose of the rest of the goods as they see fit. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.
In addition to the order for disposal, the landlord is seeking removal and disposal costs of $662.50. Considering the volume of items this is reasonable.
As the landlord has been wholly successful, I must order reimbursement of the filing fee.
