The tenants must pay the amount owing in order 2 at the rate of $50.00 per week.
The first payment must be made on Tuesday 18 March 2024 and payments must continue every Tuesday until the amount owing is paid in full.
If the tenants fail to make any payment within 2 working days of a due date, the balance of the debt owing will be payable immediately and can be enforced through the District Court.

Reasons

The landlord’s representative and both tenants attended the video hearing today.
The parties signed a fixed term tenancy agreement in late November 2023 for a tenancy to start on 8 December 2023. A few days after signing, the tenants found an alternative property to rent which suited their family circumstances better. They applied to the landlord to end this tenancy and did not move into the property.
The landlord agreed to the request on condition that the tenants remain responsible for rent until new tenants could take over and pay any reasonable expenses incurred in respect of the early termination. The tenants signed an acknowledgement of these terms.
A signed fixed term tenancy agreement is a binding contractual promise by tenants to pay rent until the end date of the term and by the landlord to provide the property until at least that date. The contract cannot be ended early unless both parties agree or by order of the Tribunal.
The landlord was able to secure new tenants from 15 December 2023 and now seeks compensation for one week of lost rent, which is $690.00.
The tenants are disappointed as they understood that interest in the property was high and had hoped that new tenants would be found to start from 8 December or earlier.
Their feelings are understandable. However, the landlord has lost one week of rent because of the early ending of the contract. I am satisfied the landlord acted reasonably and prudently to secure new tenants, so I award the claim.
The tenants have already paid the landlord’s invoiced expenses related to the early termination (approximately $300.00). This hearing enabled them to explain their point of view, which is their right.
The landlord has succeeded in the claim so is also awarded the filing fee and is entitled to suppression of name, as applied for.
