How much is owed for rent?

The tenancy began on 10 November 2015 and ended on 3 December 2023 by notice given by Mr Kikhounga, who appears to have been acting as the head tenant. The tenancy arrangements appear to have been relatively informal, with tenants coming and going, and the lease not being updated accordingly.

The landlord provided rent records which prove the amount owing at the end of the tenancy was $6617.72. However, this full amount appears to relate to arrears dating back some considerable period of time. Mr Dacombe-Bird advises that a previous application to the Tribunal was withdrawn, as it was impossible to prove which of the various tenants were liable for the arrears which accrued over time. Instead, this application is brought against those tenants who took over the bond of $3,200 on 8 November 2022. Reviewing the record of rent arrears, I am satisfied that the arrears that have accrued since November 2022 exceed the bond.

Mr Singh acknowledged that he stopped paying his rent on 15 October 2023, when he went overseas on holiday. He advised that he attempted to re-rent his room but was unable to do so due to the rent arrears owed. He argues that he should not be liable for the arrears to be deducted from his portion of the bond, as he had paid his rent prior to going on holiday.

During the hearing I explained to Mr Singh that the lease arrangements mean this is a joint tenancy and the tenants are joint and severally liable for paying the rent. The effect of this is that even though Mr Singh may have diligently paid his rent before he left, he is still liable for arrears from other tenants not paying theirs. In any event, by his own admission Mr Singh did not pay rent from 15 October 2023, and so would be liable for a shortfall. If Mr Singh has a dispute with the other tenants about the payment of rent, it is outside of the jurisdiction of this Tribunal, but may be within the jurisdiction of the Disputes Tribunal.

I questioned Mr Dacombe-Bird whether he would seek more than simply the bond, he replied that it was not an expectation. I am satisfied that the landlord’s application has been made out and order that the bond centre is to pay the bond of $3200 to the landlord.
