Both parties attended the hearing.
The landlord had claimed $1,128.05 for various items, I consider these below: a. Cleaning; the landlord has claimed $400, however some of the cleaning claimed was for drawers in the kitchen, which the tenant never used, for shelves, windowsills, and marks in the hallway which the tenant says were in the same condition at the start of the tenancy, or for the kitchen louvres which were mossy due to the aspect and location of the tenancy. It was conceded by the landlord that the cleaning had returned the tenancy to a condition better at the start of the tenancy, and by the tenant that some areas had not been well cleaned (such as the oven). Therefore, I have reduced the award to $150. b. Carpet cleaning; the landlord has claimed cleaning for 3 stains $300. The tenant accepted that he had caused 2 of those stains. Therefore, I reduce the award to the quoted cost to clean the 2 stains, which is $253. c. Lock/key replacement; the landlord had claimed $235.75 for replacing locks. The tenant says that his aunt had returned the keys after his possessions were removed and the property had been cleaned. The landlord recalled giving the aunt the keys but could not recall whether they had been returned. The landlord conceded that it was company policy to replace locks when a tenancy has been terminated. However, a tenant cannot be liable for the cost of this policy. Therefore, nothing is awarded for this cost. d. Shower curtain/light bulb; the landlord had claimed $204.80 for the replacement of an external security lightbulb, and shower curtain. The tenant says the bulb was working when he vacated and recalled buying his own shower curtain at the start of the tenancy. I am unable to reconcile the two competing positions regarding the lightbulb, and the landlord is required to prove his case, therefore, I make no award for the lightbulb. The landlord supplied a pre-tenancy photo showing a shower curtain. I award the labour and materials for replacing the shower curtain $66.98.
