While Mrs Lee disagrees with the landlord’s claim, she has provided insufficient evidence to support her view. Other matters

Mrs Lee was concerned that she had made several attempts to contact the landlord to advise them of her change in circumstances and to initiate an income related rent review immediately, but this was fraught with difficulties and a lack of communication on the landlord’s part. She believes she has the proof to show the delay was not their fault ie. txt message communication. However, any challenge regarding the delay in processing the income related rent review is outside the Tribunal’s jurisdiction. If Mrs Lee wishes to pursue this further and to get a better understand of how the rent arrears accrued, she can ask to arrange a meeting with the Team leader or another member from the leadership team at the Kāinga Ora–Homes And Communities Henderson Office. She can take along a copy of this order, the application from the landlord and supporting documents (including the rent summaries) and her proof of her attempts to contact the landlord regarding the change in her circumstances to the meeting.
