Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not return the apartment building swipe card and garage remote control. The landlord provided an invoice from Pacific Property Management dated 12 January 2024 for a replacement swipe card and garage remote. Having sighted this evidence I am satisfied that the tenant is responsible for this debt.
The amount ordered is proved. Breach of Body Corporate Rules
The landlord has provided a copy of the tenancy agreement which clearly states that the Body Corporate Rules, as attached to the Tenancy Agreement, bind the tenant.
The landlord claims that the tenant activated the emergency release button on two occasions resulting in after-hours callouts.
The signage in the lobby area clearly indicates that in the event of inappropriate activation of the emergency release button a $500.00 fine will apply.
The landlord has provided two invoices from Pacific Property Management dated 6 and 9 November 2023 in respect of callouts on 19 October 2023 and 2 November 2023 relating to activation of the emergency release button. I have also sighted CCTV footage in support of these claims.
I am satisfied that the tenant has breached the Body Corporate Rules by inappropriately activating the emergency release button on two occasions.
The amount ordered is proved.
Because Premier Rental Management Limited T/As Zippi Property Management Ltd As Agent For G Simanke has wholly succeeded with the claim I must reimburse the filing fee.
The landlord confirmed during the hearing that they are no longer seeking name suppression.
The bond has already been released to the landlord.
