This application was initially scheduled for a full day hearing on 11 July 2024.

On the morning of that hearing the tenant e-mailed the Registry to say that she could not attend as she had covid. She was unable to be contacted by phone.

The matter was adjourned to a case conference which was held by phone on 5 September 2024. The tenant participated in the case conference.

The tenant was given leave to be represented and directions were issued for the filing of evidence (including evidence of her inability to attend the 11 July hearing for medical reasons) and the matter was allocated a full day hearing today.

The tenant did not comply with those directions. Yesterday, I asked that the Registry contact the tenant to confirm that she would be attending today and would be in a position to provide the required evidence. Messages were left for the tenant on her phone and by e-mail but no response has been received.

The landlord appeared today. The tenant did not appear when the matter was called at 9:30am. Attempts were made to phone the tenant on the number given by her in her application and on 2 other numbers held on record by the landlord. A message was left reminding the tenant about today’s hearing.

The landlord’s records indicate that the tenant phoned her tenancy manager yesterday with a maintenance request. The tenancy manager reminded the tenant about today’s hearing but on doing so, the tenant immediately hung up.

Today, I stood the hearing down to 10:30am. The Registrar e-mailed the tenant to let her know that I had done so and that in the absence of an appearance from the tenant by that time, her application would be dismissed.

There was no response to those communications and no appearance by the tenant.

I am satisfied that every available step has been taken to try and ensure the tenant had the opportunity to be heard on her application. Her application is dismissed.

As the tenant has not provided evidence to the contrary as directed, I must assume there was no valid reason for her failure to attend the hearing on 11 July 2024 and a second day of hearing time has now been lost.

In terms of s.102(2)(d) that would warrant an award of costs being made.

The landlord confirms that no order for costs is sought.
